Direct Response Media Group, Inc. (“DRMG,” “we,” or “us”) cares about your privacy. This Privacy Policy explains how information about you is collected and used by DRMG. By using the DRMG websites, products, services, mobile apps (“app(s)”), and applications (collectively, “Services”), you agree to the DRMG Privacy Policy.

DRMG reserves the right to modify this Privacy Policy at any time, and we encourage you to review it frequently. Modifications will be posted to the Privacy Policy on the DRMG website. If we make any material changes, we will notify you by means of notice on the website when a change is made. Your continued use of the Services signifies your acceptance of our Privacy Policy as modified.

Information We Collect

We collect information to improve our Services and to provide better experiences to all of our users. DRMG collects both personal information and non-personal information.  

“Personal Information” is information that can be used to identify, locate, or contact an individual. It also includes other information that may be associated with Personal Information.

We collect the following types of Personal Information:  

Contact information that allows us to communicate with you, such as your name, postal addresses, email addresses, social media website user account names, telephone numbers, or other addresses at which you receive communications from or on behalf of DRMG.

Billing and payment information as needed to process payments for our Services, such as your credit or debit card number, expiration date, and card verification number.

“Non-Personal Information” is information that, alone, cannot be used to identify or contact you. Such Non-Personal Information may include, for example, gender, birthdate, or zip code. You may be asked to submit Non-Personal Information with Personal information, or separately.

We collect such information in two ways: (1) Information you provide; and (2) Information we receive from your use of our Services.

Information You Provide

We collect Personal Information when you:

Send DRMG any electronic communication (via an email or other app or website database form);

Enter contests as may be available from time-to-time;

Complete a user account;

Order products or services including free-trials;

Submit online applications and forms to DRMG;

Create shopping cart data, as and when available;

Subscribe to newsletters;

If you use a social media platform or your mobile device (or other method of communication) to interact with DRMG, the communication method or application may have a specific privacy policy that governs the use of Personal Information.

Automatically Collected Information

When you use DRMG Services, we may collect certain information as described below for such purposes as improving our products and services, troubleshooting bugs, providing the Services, managing the Services, tracking usage, providing content for referring traffic sources, and improving overall performance of the Services. Such information may include: IP address; profile information; aggregate user data; preferences; technical session information; browser type; information about your computer, hardware, software, or mobile device, including a device identifier; demographic information including gender, zip code and age; and navigational data including log files, server logs, clickstream data, and other data such as your location, where enabled, and language preference. User IP addresses are recorded for security and monitoring purposes. If you arrived at our website via a link from another webpage, we may receive aggregate or otherwise anonymous statistical information about your visit to our site. We monitor customer traffic patterns and site usage to help us develop the design and layout of the site, and to improve the content of our website to better match the interests of our website users. We may combine this automatically collected and other Non-Personal Information with Personal Information, in which case we will treat the combined information as Personal Information under this Privacy Policy.

Cookies and Related Technologies

When you use DRMG Services, we collect certain information by automated or electronic means, using technologies such as cookies, pixel tags and web beacons, browser analysis tools, and web server logs. As you use the Services, your browser communicates with servers operated by us, our business partners, and service providers to coordinate and record the interactivity and fill your requests for services and information.

The information from cookies and related technology is stored in web server logs and also in web cookies kept on your computers, which are then transmitted back to our website by your computers. DRMG, our business partners, or our service providers operate these servers and manage the cookies.

You may set your browser to block all cookies, including cookies associated with our Services, or to indicate when a cookie is being set by us. However, it’s important to remember that many of our Services may not function properly if your cookies are disabled. For example, we may not remember your language preferences. Some web browsers and mobile device operating systems offer Do Not Track (DNT) settings. Currently, there is no industry standard for offering or responding to this setting. DRMG Services and Customer Data

When we provide the Services to our customers, customer data is stored on our computers and servers. DRMG will not share, distribute, or reference any such customer data except as provided in an applicable Customer or Partner MSA, or other related agreement, or as may be required by law.

How DRMG Uses Information We Collect

DRMG uses information to:

Operate and improve our websites and Services;

Provide customers with offers for products and services from DRMG, including offers based on variables, such as stated and anticipated customer interests;

Facilitate orders for products or services;

Evaluate eligibility of customers for certain offers, products, or services;

Track redemption of products or services and perform other analytics;

Provide customer support, including support to our merchants or business partners;

Fulfill requests for DRMG products or services;

Communicate and provide additional information that may be of interest to you about DRMG, our merchants, and our business partners, such as news, special offers and coupons, announcements, and marketing materials;

Send you reminders, technical notices, updates, security alerts and support, and administrative messages, service bulletins, or marketing materials;

Administer sweepstakes, contests, or other promotional activities or events sponsored by us;

Manage our everyday business needs, such as website administration, fulfillment, analytics, fraud prevention, compliance with the law, or enforcement of our corporate reporting obligations, terms, and conditions; and

Aggregate anonymous data from our Services, used to benchmark, to improve the Services, and to provide data analysis.

If you do not want to be on our mailing list, you can opt out anytime by sending an email to customercare@DRMG.com or clicking on the “unsubscribe” button on our communications. From time to time, we may use your Personal Information to send important notices to our customers regarding material changes to our terms, conditions, and policies or purchased products and services which you may not opt out of receiving if you are a current customer.

How DRMG Shares Information We Collect

We will not disclose your Personal Information to third parties except to our service providers that provide services for us such as sending emails on our behalf and processing payments. Our service providers are bound by law or contract to protect the Personal Information and are only allowed to use the Personal Information in accordance with the terms of our service agreements with them. We do NOT share, sell, rent, or trade Personal Information with third parties for their own promotional purposes, and we will only share Personal Information as outlined herein or with your consent.

From time to time, DRMG may partner with other companies, such as our official partners, to jointly offer products or services. If you purchase or specifically express interest in a jointly–offered product or service from or through DRMG, we may share Personal or Non-Personal Information about DRMG customers collected in connection with your purchase or expression of interest with our partners. DRMG does not control our business partners’ use of such information, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your Personal Information to be shared in this manner, you may opt not to purchase or not specifically express interest in a jointly-offered product or service.

DRMG may aggregate information collected by the Services or via other means so that the information does not identify you. Our use and disclosure of anonymous, aggregated information, and other Non-Personal Information, is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any legal purpose.

Accessing and Correcting Personal Information

You can access, update, and delete your Personal Information, including financial information, by sending us an email at info@DRMG.com.

We will retain your information for as long as your account is active or as needed to provide you services and to maintain a record of your transactions for financial reporting purposes. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. When the data retention period expires for a given type of data, we will delete or destroy it.

How We Protect Your Personal Information

The security of your personal information is important to us. We have implemented reasonable administrative, technical, and physical security measures to protect against the unauthorized access, destruction, or alteration of your information. Despite our best efforts, however, no security measures are completely impenetrable.

Use of DRMG Online Forums

The Services may contain user submitted content, comments, and opinions in online forums and communities, for example, the DRMG Marketplace or FAQs.  Such content is for informational purposes only, and DRMG is not responsible for user-submitted content. DRMG may provide or recommend responses as a possible solution based on the information provided; every potential issue may involve several factors not detailed in the conversations captured in an electronic forum, and DRMG can, therefore, provide no guarantee as to the efficacy of any proposed solutions on the community forums. DRMG disclaims any and all liability for the acts, omissions, and conduct of any third parties in connection with or related to your use of the Services.  We recommend and caution all users not to disclose Personal Information within the forums or communities.  DRMG does not pre-screen third-party user content and does not undertake the responsibility to remove any harmful or offensive content, but reserves the right, in our sole discretion to remove any and all content for any or no reason at any time.

Data Transfers from the EU and Switzerland to the United States

DRMG complies with the EU-U.S. Privacy Shield Framework and the Swiss–U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information transferred from the European Union and Switzerland to the United States, respectively. DRMG has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. DRMG is responsible for the processing of Personal Information it receives under the Privacy Shield Framework and subsequently transfers to a third party acting as an agent on its behalf. We comply with the Privacy Shield Principles for all onward transfers of personal data from the EU and Swiss, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, we are subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

EU and Swiss individuals have the right to access, correct, transfer, erase, restrict collection, retention, and transfer of their personal data. DRMG retains personal data for as long as it is necessary and relevant to the purpose of processing. In addition to the rights provided in this Privacy Policy, please note the following: Because DRMG personnel have limited ability to access data that our customers submit to our Services, if you wish to request access, to limit use, or to limit disclosure, please provide the name of the DRMG customer who submitted your data to our Services. We will refer your request to that customer, and will support them as needed in responding to your request.

If you have any questions or concerns, we encourage you to write to us as indicated below. We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Information in accordance with the Privacy Shield Principles. If an issue cannot be resolved through our internal dispute resolution mechanism, individuals may contact or submit a complaint, at no cost, to the JAMS EU-U.S. or Swiss-U.S. Privacy Shield Program, which is based in the United States and which serves as our third-party alternative dispute resolution provider. We will cooperate with JAMS pursuant to the JAMS International Mediation Rules, which are accessible on the JAMS website at http://www.jamsadr.com. For residual complaints not fully or partially resolved by other means, you may be able to invoke binding arbitration as detailed in the Privacy Shield Principles.

Children

If you are under 18, or the age of majority in the jurisdiction in which you reside, you may only use the Services with the consent of your parent or legal guardian.

The Services are not intended for or targeted at children under 13, and we do not knowingly or intentionally collect information about children under 13. If you believe that we have collected information about a child under 13, please contact us at legal@DRMG.com, so that we may delete the information.

California Privacy Rights

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of Personal Information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. In particular, the law provides that companies must inform consumers about the categories of Personal Information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. As discussed above, we do not currently share Personal Information with third parties for their own marketing purposes.
